1. Quotes and how long they last

• Every quote shows its own expiry date. A quote is open for acceptance until that date, and we may need to re-price it after that.
• Commercial tender offers remain valid for 60 days from the tender submission date unless the tender states otherwise.
• Where quoted equipment is imported, the price of major imported equipment is subject to exchange rate variation as at the date the contract is awarded.

2. What a quote covers

A quote covers only the work described in it. The following are excluded from every quote unless the quote expressly includes them:

• additional work beyond the described scope;
• work outside our normal hours (Monday to Friday, 7:00 am to 5:00 pm);
• mains upgrades, switchboard upgrades, earthing upgrades and other electrical upgrades not listed in the scope;
• rectification of pre-existing faults we find that are outside our quoted scope of work, which we will report to you with a price to fix; and
• building works, painting, patching, coring, penetrations, fire rating and cranage.

If we uncover something unsafe or non-compliant while on site, we will tell you what we found, what it means and what it would cost to put right before any extra work goes ahead.

3. Variations and extra work

Work outside the quoted scope is a variation. We price variations before we do them and proceed once you have accepted the price. We do not invoice surprise extras.

4. Access, scheduling and delays

• Quoted prices assume the work is carried out during normal hours with free and easy access to the work area.
• We are not responsible for delay or downtime caused by third parties, changes to the schedule, inclement weather, programmed works or matters shown differently on the drawings we quoted from.
• If access or scheduling changes add real cost to the job, we will treat the difference as a variation and agree it with you first.

5. Payment

• Invoices are payable by the due date shown on the invoice, by bank transfer using the details on the invoice.
• Card payments may attract a card processing fee, which is shown before you pay.
• All prices are in Australian dollars. GST is shown on every quote and invoice.

6. Commercial and construction tenders

The following applies to commercial, construction and mechanical-services tenders in addition to the terms above:

• Our tender price assumes associated works by other trades are provided in accordance with the specification.
• We allow for site supervision covering the site safety plan, OH&S inductions, trade scheduling and client liaison.
• Liquidated and pre-ascertained damages, where applicable, are limited to a maximum of 5% of the contract sum.
• Retention, if required, shall not exceed 5% of the contract sum, reducing to 2.5% at practical completion.
• Temporary power (including 240 V power), lighting, water and site accommodation are to be provided at no cost to us.
• Unless the tender expressly includes them, mechanical-services tenders exclude: supply and installation of the mechanical services switchboard (MSSB); chilled-water or condenser-water pipe cladding; motorised valves and energy meters for CHW or CW circuits; balancing of the entire floor; condensing cages; tundishes (by others); cutting and patching of ductwork and mechanical equipment; EWP and scaffold hire; footings or concrete plinths for mechanical equipment; and dilapidation surveys and reports.

7. Liability

To the extent permitted by law, JOONDALUP ELECTRICAL CONTRACTING is not liable for indirect or consequential loss or damage, loss of contract, profit or revenue, production stoppage or the cost of replacement services, whether the claim is based on breach of contract, breach of warranty, tort, negligence, strict liability or any other legal theory. This limitation does not apply to liability that cannot lawfully be excluded, and it does not exclude, restrict or modify any right or remedy you have under Australian Consumer Law.

8. Our workmanship guarantee

Eligible work is covered by our 10-year workmanship guarantee. The guarantee page sets out what is covered, what is excluded and how to make a claim, and includes the consumer guarantees wording required under Australian Consumer Law.

9. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Consumer information is available from the Australian Competition and Consumer Commission.
